1. Acceptance of Terms

By accessing or using AutoFund365 ("Service"), operated by AutoFund365 ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

These Terms constitute a legally binding agreement between you and AutoFund365. You must be at least 18 years old to use our Service.

2. Description of Service

AutoFund365 provides an AI-powered cryptocurrency lending optimization service for the Bitfinex exchange. Our Service:

• Automatically manages and optimizes your Bitfinex funding offers
• Analyzes market conditions to determine optimal lending rates and durations
• Operates 24/7 via the Bitfinex API using credentials you provide
• Supports multiple cryptocurrencies and fiat currencies

AutoFund365 does not hold, custody, or control your funds. Your assets remain on Bitfinex at all times.

3. Account and API Access

3.1 Bitfinex Account

You must have an active Bitfinex account to use our Service. You are solely responsible for your Bitfinex account, including compliance with Bitfinex's terms of service and any applicable regulations in your jurisdiction.

3.2 API Key Requirements

• You must provide a Bitfinex API key with funding permissions only.
• You must not grant withdrawal permissions to the API key used with our Service.
• You are responsible for the security of your API credentials before sharing them with us.
• You may revoke your API key at any time through your Bitfinex account settings.

3.3 Account Security

You are responsible for maintaining the security of your accounts and credentials. Notify us immediately if you suspect unauthorized use of your account.

4. Subscription and Payment

4.1 Plans and Pricing

We offer multiple subscription tiers with varying features and currency support. Current pricing is displayed on our website and may be updated from time to time with reasonable notice to existing subscribers.

4.2 Billing

• Subscriptions are billed monthly or annually as selected at signup.
• Payment is due at the beginning of each billing cycle.
• All fees are non-refundable unless otherwise stated.

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, the Service will continue until the end of your current billing period. After cancellation, your API credentials will be deleted from our systems within 30 days.

5. Risk Disclosure

By using our Service, you acknowledge that you understand these risks and accept them. AutoFund365 is not a financial advisor and does not provide investment advice.

6. Limitations of Liability

To the maximum extent permitted by law:

• AutoFund365 is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not guarantee uninterrupted, timely, secure, or error-free service.
• We are not liable for any losses resulting from lending activities, market fluctuations, Bitfinex platform issues, or AI optimization decisions.
• Our total liability for any claim arising from or related to the Service shall not exceed the fees you paid to us in the 12 months preceding the claim.
• We are not liable for indirect, incidental, special, consequential, or punitive damages.

7. User Responsibilities

You agree to:

• Provide accurate and complete information when registering
• Comply with all applicable laws and regulations in your jurisdiction
• Not use the Service for money laundering or other illegal activities
• Not attempt to reverse-engineer, decompile, or access our proprietary algorithms
• Not share your account credentials with third parties
• Maintain sufficient balance on Bitfinex for lending activity
• Monitor your account and report any issues promptly

8. Intellectual Property

All content, features, algorithms, and functionality of the AutoFund365 Service are owned by AutoFund365 and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without written permission.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, including but not limited to:

• Violation of these Terms
• Non-payment of subscription fees
• Suspected fraudulent or illegal activity
• At your request

Upon termination, we will cease all API operations on your account and delete your API credentials within 30 days.

10. Indemnification

You agree to indemnify and hold harmless AutoFund365, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through our website. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
